Justified?

What do you think?

Myself, i'm a big proponent of companies leaving their noses at the front door when their workers punch the clock. However, there seems to be a conflict here. Most railroads are trying to reduce trespassing, but here is an employee posting enticing photos that are not company sanctioned but taken on railroad property. It certainly could encourage copycat photographers to do their business on the tracks.

Given the other issues this employee has had, it seems to me she is more trouble in the long run that will be worth. CP should cut their loses, pay the settlement, and learn better next time.

My last contract job had one of these “social media” clauses in it. I told them it’s out or i’m out. They took out the clause. Workers must start standing up to these employers who think they own you.

And she isn't the trouble, the company is. The company ** up and wrongly dismissed her, got their dicks slapped by TC for it, and now she's got a target on her back because of it.

Ive seen this happen at BNSF, who is arguably the worst carrier for OSHA Whistleblower violations among railroads. I'd have to find the statistic, again, but I recall that they had the highest number of whistleblower cases against them that were validated.

Railroads don't like people stirring their pots.

!*roll-laugh*! G&W up here is the same way or worse especially if you aren't from the area and aren't part of the employee\management buddy system. As far as my opinion, if you're not on company time then they should have no say in your personal life or the time you spend not on the clock where social media is concerned.

This subject will be debated until the cows come home. Read the employee manual with care and if you sign any agreement as a condition of employment make sure you read it. Anything else is non-binding. Anything beyond that is just legal/lawyer bs. The employee manual may say something like if you go to work for the company you are agreeing to the rules in this manual. Sketchy. My company makes you sign a document that says you have read and understood the manual. Solid. we don't care what you do on your own time as long as you don't come to work under the influence of alcohol or drugs or are otherwise physically or mentally impaired. Some of our folks are guilty of the second on a regular basis. !*roll-laugh*!

What I say is: don´t tell the boss what is your facebook, twitter and instagram names.
Unless it goes against the law, job rules or the good or right manners, it is not the business of anybody.

NJT and I think G&W have trolls that just go on the web just to hunt for employees on social media talking about the company. Originally it was keep employees from discussing company dealings but has morphed into something else. Hell I posted a picture of a downed tree that blocked us for over an hour and by the time I tied up I had a phone call about it telling me to remove the photo and comments.

See that's because you were doing something while you were on company time just like the NFL idiots a whole different conversion than action taken when you are off the clock.

Don't even get me started on the stupid things that people from my generation post and get into trouble with either school or jobs. !*roll-laugh*!

I guess my generation doesn't realize just how bad it can look to be badmouthing a college or minimum wage job. !*roll-laugh*!

That's part of the reason why I got rid of all mainstream social media when I graduated high school. Can't post anything stupid if you don't have a means to do it... and there will always be someone that gets offended no matter what you say. Just one day that could be a boss and then your screwed. !!bang!!

The lady might still be employed if she were a bit smarter about her social media use. Common sense says you dont post who you are employed by, if for no other reason than your own security. And if you are going to post some questionable stuff, make sure you know how to use the privacy settings. I learned this from my current employer due to two incidents we had here at work.

One, we had a fellow who posted a picture of himself shirtless and flexing. Another co-worker downloaded the photo from his social media account, made a few changes via photoshop, and then distributed the photo via email to just about everyone on the crew. It was a great joke, but it landed all of us in sensitivity training.

The second incident happened when a girl posted some racial slurs on her social media account. She wasn't even followed by the Company, but someone in the front office caught wind of it and checked out her open-access account. They threatened to fire her if she did not immediately remove the stuff. A big tussle ensued, and it is not known exactly what was said, but the content was not removed and she was not terminated - immediately anyway.

It is even worse working for non-union companies in "Right-to-work" states. No protections whatsoever.

Curious, what exactly did Norvell do, throw the locomotive in reverse and gun the throttle? Were there dynamics onboard and available?

Put it in reverse and applied throttle is what it says. Doesnt explain how much. I know the times I've pulled throttle and had slack push against the direction of intended travel, they don't tend to like it even in notch 1.
Dynamics on Geeps dont do jack under 10 MPH. Especially with cars. Im going to venture a guess he didn't have train air either since it was a yard move.

I can maybe see a case for dismissal depending on what exactly it was she said about the company, but the rest is utter bunk and absolutely reeks of retaliation over the assault complaint. I wouldn't be surprised if someone tries to take advantage of her racy pictures to try to slut-shame her and say she was "asking for it".
